Foley, who joined Kubota last year, put in a high tackle on Kobelco number eight Lui Naeata from the back of a scrum in the first half which resulted in a straight red card for the former Australia star.
Despite playing more than half the game with one man fewer, Kubota went on to win the match 23-21 to set up a semi-final against Suntory Sungoliath next weekend.
Foley, 31, has earned 70 caps for Australia since making his debut in 2013 and has also represented the Waratahs more than 100 times throughout his career.
